Proton Marketing provides branding, marketing, web development, and app development services. The specific scope, deliverables, pricing, and timelines for any project will be outlined in a separate proposal or agreement provided to the client before work begins.
2. Proposals and Quotations
Any quote, proposal, or package pricing shared with you is valid for the period stated in that document (or 30 days if unspecified) and is subject to change thereafter. Final project terms are confirmed only once both parties agree in writing.
3. Payments
- Payment terms (including deposits, milestones, and final payments) will be specified in your individual project proposal or invoice.
- Until full payment is received, all deliverables — including designs, code, and other project assets — remain the property of Proton Marketing.
- Upon receipt of full payment, ownership rights to the agreed deliverables transfer to the client, as specified in the relevant proposal.
4. Revisions
Each service package includes a defined number of revisions as outlined in the proposal. Additional revisions beyond this scope may be subject to extra charges, which will be communicated before any additional work begins.
5. Client Responsibilities
To ensure timely delivery, clients are expected to:
- Provide necessary materials, content, and feedback in a timely manner
- Respond to requests for approvals within a reasonable timeframe
- Ensure any third-party accounts, licenses, or assets needed for the project are made available as required
Delays caused by the client may affect project timelines.
6. Intellectual Property
Unless otherwise agreed in writing, Proton Marketing retains the right to showcase completed work in our portfolio, case studies, and marketing materials, including on our Site and social media channels.
7. Third-Party Tools and Platforms
Some projects may involve third-party platforms (e.g., WordPress, Shopify, hosting providers). Proton Marketing is not responsible for the policies, pricing, or performance of third-party services, though we will advise clients on suitable options.
8. Limitation of Liability
Proton Marketing strives to deliver high-quality work, but we do not guarantee specific business outcomes (such as revenue, traffic, or rankings) resulting from our services, as these depend on many factors outside our control.
To the maximum extent permitted by law, Proton Marketing shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or Site.
9. Cancellations and Refunds
Cancellation and refund terms will be specified in individual project agreements. As a general policy, deposits paid for work already in progress are non-refundable, but unused portions of payment for work not yet started may be refunded at our discretion.
10. Governing Law
These Terms shall be governed by and interpreted in accordance with applicable laws, without regard to conflict of law principles. Any disputes will be resolved through good-faith discussion between the parties in the first instance.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of our Site or services after changes are posted constitutes acceptance of the revised Terms.
